Re: this photo, it also should be noted that I searched for over an hour through all my past posts (over 1500 holy hell I've had this blog for a long time) to find this particular photo, so determined I was to show you some "before" action. And during that hour (who am I kidding, it was two hours), I teared up more than once (and not just because I couldn't find the damn photo). It was an emotional jaunt down memory lane courtesy of the old blog. Those girlies of mine...they're big. They're not babies anymore. (Case in point, that's Audrey up there looking so little and Millie-esque.) It's freaking me out. Melancholy city friends.?


But back to the patio (and sorry for the massive digression)... Pre-operation loungify, we never sat out there. Now, we're out there all. the. time. We are officially patio dwelling peeps. Morning coffee, evening G&Ts, plowing through a massive stack of magazines on Saturday morning, hanging with the girlies and Bryan, typing this post. I never want to leave the freaking patio. I'd sleep out there if I weren't too chicken to sleep outside.

(AP) ? Spain's borrowing costs soared Wednesday to reach their highest level since the country joined the euro Wednesday, close to levels where other debt-stricken countries such as Greece and Ireland have asked for an international bailout.

The interest rate ? or yield ? on Spanish 10-year bonds, a key indicator of market confidence in a country's ability to pay down its debt, shot up 25 basis points Wednesday to 6.67 percent ? matching the level it hit at the height of the eurozone crisis late last year. The yield later fell back to hit 6.66 percent in afternoon trading.

A yield of seven percent is seen by many analysts as unsustainable for a country to continue financing itself over the long term. Meanwhile, the difference between the Spanish bond and the equivalent safe-haven German bunds was a record 5.36 percentage points.

The country's conservative government has introduced harsh austerity measures, including spending cuts on health and education, in an attempt to control the level of its debt relative to the size of its economy.

It is also trying to reassure investors worried that the woes of the banking sector will force the country to require a bailout like those take by Greece, Ireland and Portugal. Spain's banking industry has been saddled with a large amount of unpaid, so-called "toxic", loans on their books following the collapse of the country's real estate bubble in 2008. There is a concern that Spain's government will not be able to find the funds to prop up the sector and keep its economy afloat.

Concerns over Spain's nationalized lender Bankia, and the government's ability to come up with a ?19 billion rescue package for the bank, have sparked the latest round of investor fears over the country.

Earlier Wednesday, the government vehemently denied newspaper reports that the European Central Bank had rejected a Spanish idea to finance a bank bailout and it defended the country as sound.

The Financial Times reported Wednesday the ECB rejected the idea of Spain paying for the ?19 billion bailout of struggling nationalized lender Bankia by using government bonds, which would then be used as collateral for cash from the ECB.

Economy Minister Luis de Guindos, speaking to opposition Socialist lawmakers during a debate in Parliament, denied the report.

"Pay more attention to the Spanish government and less to the Financial Times." De Guindos said. "The government of Spain has not presented any plan to the European Central Bank, nor has the European Central Bank rejected anything in this regard."

Speaking later to reporters in what seemed an impromptu and desperate effort to talk the bond spread down, de Guindos noted that Italy's yield on its 10-year bonds were also sharply up Wednesday.

The minister defended the government as transparent on what it plans to do with the banking sector, heavily laden with billions of euros in toxic assets after the implosion of a real estate bubble. New provisioning requirements to the tune of ?84 billion have been ordered, two independent audits of banks' loan portfolios will take place, and an IMF report will come out in June.

"We will shine the light on what the consequences of the financial crisis have been for the banks," de Guindos said.

He said Spain's bond spread ? at over 530 points now ? are "not very sustainable over the long term" ? will come down once uncertainty over the Greek political situation is resolved. A recent election there failed to produce a government amid discord over EU-mandate austerity that came along with a mountain of bailout money.

De Guindos also insisted that the Spanish treasury is "perfectly well financed" and that aside from money for bond redemptions it needs to carry out just ?3 billion in net debt issuance from now to the end of the year.

The European Central Bank issued a statement saying that it had not been consulted about Spain's recapitalization plans for Bankia and had not expressed a position about them. The statement said the ECB "stands ready to give advice on the development of such plans."

Spain's Ibex 35 stock index was down about 1.53 percent at 6,156.

The European Commission is due to set out its annual economic strategy report Wednesday, when it will issue recommendations for each of the 27 European Union members ? including Spain.

New Mexico wildfire spreads smoke across state

ALBUQUERQUE, N.M. ? Firefighters are battling a massive wildfire in southwestern New Mexico that has destroyed a dozen cabins and spread smoke across the state, prompting holiday weekend air-quality warnings.

The fire burned early Saturday through remote and rugged terrain around the Gila Wilderness and has grown to 85,000 acres or more than 130 square miles.

The heavy smoke apparently disoriented six hikers Friday, prompting the New Mexico National Guard to carry out a rescue.

Col. Michael Montoya said one of them had an injured knee and had to be taken to safety by ambulance. The others were able to walk to a secure area.

They said the effects on most people would be minor but noted mild throat and eye irritation or allergy-like symptoms could be expected. Officials warned people with heart and lung conditions to be especially diligent in minimizing their exposure to the smoky air.

Meanwhile, in Colorado, officials said heavy air tankers and thousands of firefighters were on standby Friday as fire managers kept a close watch on high winds and hot temperatures at the start of Memorial Day weekend. Fire danger remains high in the southern Colorado foothills and the South Park area.

Two heavy air tankers have been taken to Grand Junction in western Colorado, where the fire danger is highest, U.S. Forest Service spokesman Steve Segin said.

"We've got the resources. We've got the firefighters," Segin said. "We're ready."

The National Weather Service said wind gusts could reach 70 mph Saturday in some western Colorado valleys, with sustained winds of 25 to 40 mph. Most of eastern Colorado also was under a high-wind watch, with sustained winds of 25 to 35 mph and gusts up to 55 mph possible Saturday.

In Southern California, firefighters worked to corral a wildfire that has chewed through 3,100 acres of tinder-dry grass and light brush since it broke out Thursday afternoon east of Julian.

On Friday, the fire forced about 50 people to evacuate an RV park in San Diego County. It earlier prompted the evacuation of about 100 homes in the Shelter Valley area, but residents were allowed to return late Thursday.

In Arizona, residents of the historic mining town of Crown King were allowed to return home after being evacuated because of a wildfire about 85 miles north of Phoenix. The fire started May 13 and has burned more than 16,000 acres. It is 35 percent contained, fire officials said.

In Nevada, questions were being raised over fire crews' initial response to a backyard burn that rekindled two days later, destroying two homes in a rural community and scorching 7,500 acres.

A 911 recording obtained by The Associated Press showed a resident called Sunday to report that a neighbor's permitted burn in the Topaz Ranch Estates was out of control. Volunteer firefighters with the East Fork Fire Protection District arrived at the scene and then left, apparently without extinguishing the blaze.

Gusty winds rekindled the fire Tuesday, and it spread quickly through thick brush and dry grasses. Two homes and 17 outbuildings were destroyed.

District Fire Chief Tod Carlini did not immediately respond to messages seeking comment Friday.

Fearing a political backlash, the Indian government has postponed the decision to hike the diesel prices for the time being. However, economists feel that it is time the government deregulated the prices of diesel and stopped subsidizing them.

In India, diesel price is highly subsidized and is nearly 40 percent less than petrol price. After the recent price hike, petrol now costs Rs 78.57 per litre in Mumbai while diesel is priced just Rs 45.99 per litre in the city.

Unlike petrol, which is regarded as a rich man's fuel, diesel has the "common man's fuel" tag. The agrarian rural India depends on diesel and kerosene for its farming purposes, and freight charges are also depended on diesel. These make a hike in diesel prices a political issue in the country and successive governments have kept the diesel prices low by subsidizing them. Therefore, the government still regulates the diesel prices while petrol prices were deregulated two years ago.

Economists feel that it is high time the government woke up to the reality that diesel price subsidies are helping the rich rather than the poor farmers. "The sooner the government bites the bullet, the better," Business Today quoted Sunil Sinha, director, Research, at ratings agency CRISIL.

The economists also feel that the government's current strategy of cutting the taxes will be counterproductive as by resorting to such measures, the government will be losing considerable revenue, which could be spent on infrastructure and development.

"If government gives up a major source of revenue like this, it could only do so at the expense of either cutting sharply its development expenditure or?raising the level of deficit financing. Either way it would be counterproductive for a government committed to raising the growth rate and also making this growth inclusive," Assocham said.

However, the government should be cautious in taking the step as it has to deal with the rising inflation. "It will not be an easy decision. Increasing the price would mean a further spike in inflation. There is a direct conflict between controlling inflation and increasing the price of diesel that cascades into inflation,"," Ajit Ranade, chief economist at the Aditya Birla Group, was quoted as saying by Business Today.

According to Stephen Leatherman, aka ?Dr. Beach,? there are approximately 650 major public recreational beaches in the United States. Only one, though, can be No. 1.


What strand of sand earns that designation? This year, the honor goes to Coronado Beach near San Diego, which tops Leatherman?s 2012 annual list of the Top 10 Beaches in the country. Released on Friday, the full list includes:

  3. Main Beach, East Hampton, N.Y.

The annual list, which Leatherman has compiled since 1991, is based on 50 criteria, ranging from natural conditions (sand softness, water temperature, wave size) to human-related factors (for example, noise, trash or public safety).

Stretching from the iconic Hotel del Coronado to Silver Strand State Beach, this year?s winner rose from second place in 2011 and third place in 2010.

?It?s flat and hundreds of yards wide so it?s great for walking and playing,? said Leatherman, who has spent much of his career researching and monitoring beaches as director of the Laboratory for Coastal Research at Florida International University in Miami.

?It has a fantastic Mediterranean climate. The water quality is excellent, and there?s a great lifeguarding program so it?s safe for families,? he told msnbc.com.

For Leatherman, the annual list is part of a lifelong passion for coastal environments, an interest that stretches from his childhood in Charlotte, N.C., where his parents built him a backyard sandbox, to the publication of his latest book, ?Field Guide to the Water?s Edge? (National Geographic Books, $21.95), earlier this month.

It?s also an outgrowth of his decades of research on coastal erosion, storm damage and beach safety. On this year?s list, for example, Cape Hatteras dropped from No. 5 last year to No. 10 due to the damage caused by Hurricane Irene last August.

?There?s still an inlet or two that the storm opened up,? said Leatherman. ?They?ve put up some metal bridges but there are going to be delays for people trying to get there.?

On the other hand, Hamoa Beach made the list after falling off it last year due to access restrictions implemented by an adjacent hotel. With those restrictions relaxed, the secluded beach outside Hana made a two-year jump from No. 9 to No. 5.

Meanwhile, if recent history is any guide, beach-bound San Diegans may need to prepare for an influx of visitors as local promoters will no doubt use the designation in their marketing materials for the coming year.

That was certainly the case with last year?s winner, Siesta Beach, in Sarasota, Fla. (To avoid repetition, beaches are ?retired? after their tenure in the top spot.) According to Virginia Haley, president of the Sarasota Convention and Visitors Bureau, the area waged a full-on media blitz, including nabbing the domain name NumberOneBeach.com.

The results, she said, included an 18.2 percent increase in revenue per available hotel room (revPAR, as it?s called, a standard lodging-industry metric), a nine-month increase in visitor spending of 17.5 percent over the same period a year earlier and a 647 percent increase in visits to the CVB?s website.

Some of that increase, said Haley, may also be attributed to the fact that a year had passed since the Deepwater Horizon oil spill, which put a damper on tourism throughout Florida and the entire Gulf region in 2010.

Nevertheless, she offers one more bit of support for the significance of being named the nation?s top beach.

Recent Changes to New York's Workers' Compensation Guidelines ...

May 26, 2012 -- In November 2011, the New York State Workers' Compensation Board announced that after more than 15 years it was revising its guidelines for determining levels of incapacity and wage loss from on-the-job injuries. Effective January 1, 2012, the 2012 New York State Guidelines for Determining Permanent Impairment and Loss of Wage Earning Capacity will help medical professionals, lawyers and insurance carriers evaluate and analyze medical impairment and physical function associated with work-related injury.

The updated guidelines address both schedule and non-schedule awards. Schedule awards relate to permanent impairment of extremities, hearing loss, vision loss or disfigurement of the face. Rules for deciding loss of use schedule awards are very technical and specific. Non-schedule awards cover permanent impairments not covered by a specific schedule. Common examples include issues related to the heart, brain, lungs, skin, spine and major joints.

The 2012 Guidelines leave unchanged the scheduled loss of use awards from the 1996 Medical Impairment Guidelines. The rules and guidelines for non-schedule awards underwent significant revision after evaluation by the Insurance Department's Workers' Compensation Reform Task Force and Advisory Committee (Task Force).

Maximum Medical Improvement

One major change in the 2012 Guidelines is the baseline definition of maximum medical improvement (MMI) before determining both schedule and non-schedule disabilities. The Task Force provided the following MMI definition:

"A finding of MMI is based on a medical judgment that (a) the claimant has recovered from the work injury to the greatest extent that is expected and (b) no further improvement in his/her condition is reasonably expected. The need for palliative or symptomatic treatment does not preclude a finding of MMI. In cases that do not involve surgery or fractures, MMI cannot be determined prior to 6 months from the date of injury or disablement, unless otherwise agreed to by the parties."

Wage Earning Capacity

The Task Force also provided a three-prong analysis for loss of wage earning capacity determinations:
- Evaluation and ranking of medical impairment
- Evaluation of functional ability/loss
- Determination of loss of wage earning capacity based on impairment, function and vocational factors (including education, skills, literacy, age, etc.)

The goal of the 2012 New York State Guidelines for Determining Permanent Impairment and Loss of Wage Earning Capacity is to provide lawyers, medical professionals and claims professionals with the tools they need to evaluate and successfully resolve workers' compensation claims.

The founders acknowledge that some people might object to the notion of applying game mechanics to the institution of marriage ? supporting a sacred bond using the same psychology that motivates someone to spend hours slingshotting little birds at nefarious pigs.

But the Kouply founders believe their approach can help to address a serious problem.?Someday they even hope to see marriage counselors prescribe Kouply.

Kouply isn?t the only app pursuing this strategy of gamifying relationships. Another example is?PairSpark, a Seattle startup with apps for iPhone and Android.

Kouply is notable in part for its underlying privacy settings and sharing features. Couples are treated as individuals in relation to one another inside the app, with separate scores of their own, but they?re seen as single entity when viewed by their friends in Kouply or Facebook.

Through privacy settings, both members of a couple must agree to share a particular piece of information before it?s made public.

There's nothing like a new pair of eyeglasses to bring fine details into sharp relief. For scientists who study the large molecules of life from proteins to DNA, the equivalent of new lenses have come in the form of an advanced method for analyzing data from X-ray crystallography experiments.

The findings, just published in the journal Science, could lead to new understanding of the molecules that drive processes in biology, medical diagnostics, nanotechnology and other fields.

Like dentists who use X-rays to find tooth decay, scientists use X-rays to reveal the shape and structure of DNA, proteins, minerals and other molecules.

As X-rays pass through atoms they reflect distinctive patterns, which reveal what atoms are present and how atoms are bonded to each other. However, some data are typically discarded because of concerns over quality. In particular, data derived from edge regions of the pattern ? although very important for understanding the details of structure ? are often overwhelmed by the random errors associated with a weak signal in the midst of a lot of background noise.

Oregon State University biophysicist Andy Karplus and his colleague Kay Diederichs at the University of Konstanz in Germany have now proven that useful information can be gleaned from data that have about five times the noise level that was previously considered acceptable.

"The criteria that have been used in the past are way too conservative," said Karplus. "These data that people have been throwing out are actually good."

The bottom line for crystallographers is the accuracy of their molecular models. The better the model, the better it will predict the pattern created by X-rays passing through a molecule, and the better it will be to develop new drugs and nanotechnologies that operate at the molecular scale.

The new method may be the most important conceptual advance in the past 20 years in how these data are used in modeling, the scientists said. It shows how data from "noisy" parts of the measurement can still provide information, and allows scientists to see directly where the model is limited by noise in the data and where the model is a better estimate of molecular structure than experimental data.

"The question is, 'Where do we cut it off?'" said Karplus. By adding data at incremental steps and showing how the model improved, Karplus and Diederichs showed that scientists had been cutting off their analyses too soon and discarding data that could sharpen their view of molecular structure.

"The big impact on the field will be that every structure determined from here on out will be a little more accurate because people won't throw away data that are okay," Karplus said. "If you have a crummy image of the protein, it will get a little sharper. If you have a good image of the protein, it will also get a little sharper."

While the method will be an important step for X-ray crystallographers, the scientists said that other physical sciences may also find ways to benefit from this type of data quality analysis. They noted that one branch of science has been using this type of statistical analysis for many years. The field of psychometrics ? the analysis of data from psychological tests ? has used a similar technique called the "Spearman-Brown prophecy formula" to determine the minimum length of such tests.

"Now that we know that very noisy data are useful, this will presumably enable still further improvements as it stimulates new software development to do a better job of handling such weak data," said Karplus.
